The Dublin Anti-Internment Committee held a well-attended picket on Saturday (5th March) against the continuing practice of interning Irish Republicans without trial and also in support of human rights for political prisoners. At one point the picket was subjected to the unwelcome attention of the Irish political police.

The event was in furtherance of the Committee’s advertised intention to hold monthly public events to highlight the deprivation of civil rights from Irish Republicans — on both sides of the British border — through the operation of special legislation and in particular of the no-jury political courts (Special Criminal Courts in the Irish state and Diplock Court in the British colony). The Committee has admitted that it does not always succeed in holding a public event every month and in fact its most recent public appearance was during the December festive season, in solidarity with Irish Republican prisoners, when it was supported by a number of organisations and independent activists.

WHY THESE PUBLIC EVENTS?
The Dublin Committee holds these public events because it believes that most people are unaware of the abuse of civil rights in Ireland, the civil right to belong to an organisation that criticises the State and seeks profound change. The reaction of people receiving a leaflet at their public events would seem to bear this out.

Choosing a couple of extracts from their current leaflet: ‘At various times in Ireland’s history, people have been rounded up and jailed without bothering with a trial – people whom the government found troublesome and wished removed. Today the same process carries on although they don’t call it “internment” now – other names such as “due process”, “remanded in custody” are used ….”
‘Even when Republican activists are granted bail, it is on outrageous conditions such as not being permitted to reside in their own home, having to observe a curfew and wear an electronic tag, not being permitted to attend meetings and demonstrations …..’
The leaflet text makes the point that one doesn’t have to agree with the politics of Irish Republicans to see that these injustices are profoundly undemocratic abuses of civil rights — and “are ultimately a danger to all oppositional movements, whether Republican or not”. One aspect of their protest was against the denial of open family visits to Republican prisoners in the jails of the British colony in the north-east of Ireland — a violation of human rights.
The surprise in learning the facts is not confined to Irish people because often it is expressed by tourists or migrants, even if they have encountered such practices in their own countries of origin.
INTERNATIONALIST DIMENSION
An example of the interest from abroad on Saturday was of a Basque man and, separately, of two young Basque women, reacting warmly to seeing the Basque flag among the picketers. The Dublin Committee objects not only to the incarceration of Irish Republicans but also of people seeking freedom in many other parts of the world, for which reason the Palestinian and Basque flags are frequently flown on their pickets, next to the revolutionary Irish workers’ flag of the Starry Plough.
A person who expressed support for the right to campaign without state repression was, interestingly, from Barcelona. However he did not wish for Catalan independence, wanting instead a unitary but democratic Spanish state – a position held by some communists and the main socia-democratic parties there. Although his position did not concur with that of the picketers, who tend to support the struggles for self-determination, the conversation was conducted without hostility.
Not so with another individual, who approached some picketers to argue for their support for the Ukrainian state in the current armed conflict there, a question that has deeply divided the Irish Left and Republican movements. He went further and announced his support for the Azov Battalion, an East European fascist organisation integrated into the Ukrainian state’s military, at which point the tolerance of the picketers for his intervention ended and he was urged to depart.

POLITICAL POLICE INTIMIDATION
Another temporary presence unwelcome to the picketers was of three members of the Irish State’s political police. These are members of what used to be called the Special Branch but are now officially called the Special Detective Unit, formerly C3 and successor to the CID when the Irish State was created. This type of political police force is modelled on the Irish Special Branch of Scotland Yard, the HQ of the British police, founded to spy on the influence and activities of the “Fenians” (i.e the Irish Republican Brotherhood) in the cities of Victorian-era Britain. However, in Dublin under British occupation, their parallel force was the G Division of the Dublin Metropolitan Police, known as “G-men”; it was they who identified many Republican and other prisoners of the British military after the 1916 Rising, ensuring death sentences for many (though most commuted to life imprisonment) and jail sentence for many others. During the War of Independence (1919-1921 they were identified as the intelligence service of the British occupation and many were selectively assassinated by the IRA of the time.
The Garda “Branch” (as they are known colloquially) of the Irish State have a long history of harassment of and spying on Irish Republicans, sometimes associated with violence and often with perjury in court. Their unsupported observations through the mouth of a Garda officer at the rank of Superintendent has been enough “evidence”, in the no-jury Special Criminal Court, to send many Irish Republicans to jail on a charge of “membership of an illegal organisation.”

One of these gentlemen on Saturday approached the youngest supporter of the picket, who was distributing leaflets to passers-by, identified himself as a Gárda officer in plain-clothes and demanded the young activist’s name. His accosting of the leafletter attracted the attention of others on the picket and two went quickly to support the subject of State harassment. The Branchman demanded no further information and sone moved away. However, when he had reached about half-way along the picketters, he stopped and began filming them.
At that point one of the picketers began to call out to passers-by, many of whom were tourists, that this man was a member of the secret political police, who was filming and attempting to intimidate people on a legal political protest, that this is the kind of ‘democracy’ that exists in the Irish state, etc, etc. Shortly thereafter, the Branchman departed, along with another two of his colleagues that had been observed further down towards Temple Bar.

According to picket participants this intervention of the political police represented an escalation of their attentions in recent times, though not in the least unusual in the past, when every picketer might have their name (and even their address) demanded and jotted down.
A spokesperson of the Dublin Anti-Internment Committee stated that it is independent of any political party or organisation and that it welcomes the participation at its public events of democratic individuals, whether independent activists or members of organisations and had distributed many of its leaflets. It regrets that a number of political activists — who should have an interest, even if only in self-preservation – in defending the democratic rights to organise and to protest, decline to support their events.
Recently the Queen of the UK and Commonwealth regions reached the 70th year of her reign, called by convention the “platinum jubilee” and has received congratulations from the heads of imperialist, colonial and neo-colonial states around the world. In Ireland, she has also received the congratulations of the head of a formerly Republican party now aspiring to neo-colonial government. When Mary Lou MacDonald, President of Sinn Féin praised Elizabeth II for her “long service” we should ask: service to whom and to what? We are also entitled to compare her words to those of James Connolly, Irish revolutionary socialist and republican, in reference to the British Monarchy.
WHAT THE PRESIDENT OF SINN FÉIN SAID
Mary Lou McDonald, President of Sinn Féin was widely reported reacting to the news that a tree is to be planted in the grounds of Parliament Buildings at Stormont to mark the anniversary.
“I think it is important that we are respectful of the identity of our citizens who are British,” she said on Thursday.
“I think that is entirely appropriate and I welcome that decision.
She was reported wishing well to those who will celebrate the jubilee, and said she believes those who won’t “are now big enough, bold enough, generous enough to acknowledge the identity of others.”
“Can I also extend to the British Queen a word of congratulations because 70 years is quite some record,” she added.
“That is what you call a lifetime of service.”
Any logical consideration of those words should quickly find some problems with them. What does “respecting the identity of our (Irish) citizens who are British” or “acknowledging the identity of others” actually mean? One would imagine that respecting the identity of others would involve primarily not subjecting them to discrimination, racism or religious sectarianism. Does respecting the national identity of any people give them the right to seize with armed force and occupy a part of the nation? Because that is what constitutes the basis for the British colony of the Six Counties in Ireland and the administration of that colony is the purpose of the Stormont Parliament and Executive. Furthermore, discrimination and sectarianism is precisely what is suffered by a huge part of the population of that colony – from the very institutions being upheld by SF and by its President.
Stripped down to its essentials, we are only “big enough, bold enough, generous enough” if we accept the partition of our small nation, the forcible retention of a colony and pay our respects to the Head of that state and the Commander-in-Chief of its armed forces.
This is a monarch who has presided over her armed forces’ participation in at least 24 wars or interventions since her inauguration, two of them in our national territory. Her armed forces invaded foreign lands, bombed and shot down those who resisted, carried out massacres, tortured prisoners and she has personally decorated the leaders of those armed forces, including those who murdered Irish people. The very least one could expect from an Irish politician with any dignity would have been silence or “no comment” on the occasion.

This is far from the worst thing that the Sinn Féin leadership has done with regard to the British Monarch, for in May 2011 they called for no protests against her while she desecrated the Garden of Remembrance in Dublin and while the Gardaí attacked “dissident” Republican protesters nearby and outside her state reception in Dublin Castle, the old seat of her royal enforcers in Ireland. The following year, Martin McGuinness, prominent in the leaderships of both the IRA and Sinn Féin, welcomed her to her colony and shook her hand.

WHAT JAMES CONNOLLY SAID
James Connolly on occasions too referred to contemporary British monarchs – but in markedly different terms to those from the leadership of Sinn Féin in recent decades.
“What is monarchy? From whence does it derive its sanction? What has been its gift to humanity? Monarchy is a survival of the tyranny imposed by the hand of greed and treachery upon the human race in the darkest and most ignorant days of our history. It derives its only sanction from the sword of the marauder, and the helplessness of the producer, and its gifts to humanity are unknown, save as they can be measured in the pernicious examples of triumphant and shameless iniquities.
“Every class in society save royalty, and especially British royalty, has through some of its members contributed something to the elevation of the race. But neither in science, nor in art, nor in literature, nor in exploration, nor in mechanical invention, nor in humanising of laws, nor in any sphere of human activity has a representative of British royalty helped forward the moral, intellectual or material improvement of mankind. But that royal family has opposed every forward move, fought every reform, persecuted every patriot, and intrigued against every good cause. Slandering every friend of the people, it has befriended every oppressor. Eulogised today by misguided clerics, it has been notorious in history for the revolting nature of its crimes. Murder, treachery, adultery, incest, theft, perjury – every crime known to man has been committed by some one or other of the race of monarchs from whom King George is proud to trace his descent.

“Fellow-workers, stand by the dignity of your class. All these parading royalties, all this insolent aristocracy, all these grovelling, dirt-eating capitalist traitors, all these are but signs of disease in any social state – diseases which a royal visit brings to a head and spews in all its nastiness before our horrified eyes. But as the recognition of the disease is the first stage towards its cure, so that we may rid our social state of its political and social diseases, we must recognise the elements of corruption. Hence, in bringing them all together and exposing their unity, even a royal visit may help us to understand and understanding, help us to know how to destroy the royal, aristocratic and capitalistic classes who live upon our labour. Their workshops, their lands, their mills, their factories, their ships, their railways must be voted into our hands who alone use them, public ownership must take the place of capitalist ownership, social democracy1 replace political and social inequality, the sovereignty of labour must supersede and destroy the sovereignty of birth and the monarchy of capitalism.

SUPPORT FOR SINN FÉIN
Most followers of the Sinn Féin party, who are by long tradition anti-monarchist and desire a reunified and independent Ireland, tend to regard those kinds of heretical statements by the party leaders as no more than some kind of camouflage to get them into power. Once there, they imagine, their party will lead them to the hallowed objectives of Irish independence and unity. In fact, the same kind of attitude that was that of the early followers of Fianna Fáil, “the Republican party”3.
The blindness, or more accurately the ability of self-deception exhibited by these followers is amazing. The majority continued to believe the leadership when it publicly abandoned armed struggle against British colonialism and declared it would never return to that (believing that to be a fake position) and even when it had most of its arms decommissioned. Then the party not only fielded candidates in elections in the partitioned Irish state but also in the colonial one and, in arguably its greatest betrayal of its previous position, participated in the running of the colonial state which it continues to do. Since then its leaders have sought support for and even assisted in recruitment for the sectarian and colonial gendarmerie4 and, more recently, declared its acceptance of non-jury special courts, a clear reference in particular to the no-jury Special Criminal Courts of the Irish state5, condemned by a number of civil rights organisations6 and of which the party’s own supporters have been frequent victims.
The attitude of the larger mass of instinctively pro-independence people, mostly working-class or lower middle-class is that they might as well give Sinn Féin a turn in government – after all they can hardly treat them worse than the other gombeen7 parties that have been in government since the creation of the Irish State. Such attitudes account for the rapid growth in the party’s electoral base in recent years when it became the first party in terms of elected representatives so that two other neo-colonial parties, with a long history of hatred for one another, were obliged to join and form a coalition with a third8 in order to form a government excluding the new kid on the block.

The attitude expressed by the President of the SF party runs not only completely contrary to the traditions of Irish Republicanism but even to its own history. It is more than that, it is an expression of the lack of dignity and craven forelock-tugging attitude of the neo-colonial Gombeen class that has ruled the Irish state since its inception.
While socialists and republicans rightly condemn that mentality and its practical applications, we should place our hopes in another outlook, as outlined by Connolly over a century earlier, and in the practical expression of that outlook today and in the near future. It is surely appropriate then to end this commentary with Connolly’s own words on another British royal jubilee, Queen Victoria’s in 1897:
“….. It is time then that some organised party in Ireland — other than those in whose mouths Patriotism means Compromise, and Freedom, High Dividends — should speak out bravely and honestly the sentiments awakened in the breast of every lover of freedom by this ghastly farce now being played out before our eyes. Hence the Irish Socialist Republican Party — which, from its inception, has never hesitated to proclaim its unswerving hostility to the British Crown, and to the political and social order of which in these islands that Crown is but the symbol — takes this opportunity of hurling at the heads of all the courtly mummers who grovel at the shrine of royalty the contempt and hatred of the Irish Revolutionary Democracy. We, at least, are not loyal men; we confess to having more respect and honour for the raggedest child of the poorest labourer in Ireland to-day than for any, even the most virtuous, descendant of the long array of murderers, adulterers and madmen who have sat upon the throne of England ….
“The working class alone have nothing to hope for save in a revolutionary reconstruction of society; they, and they alone, are capable of that revolutionary initiative which, with all the political and economic development of the time to aid it, can carry us forward into the promised land of perfect Freedom, the reward of the age-long travail of the people.”9

Between 400 and 500 people gathered in Moore Street on Saturday 22nd January 2022 to hear a number of speakers declare their complete opposition to the plans of the Hammerson property group, most of which had been approved by the chief officer of Dublin City Council’s Planning Department, in the face of a great many formal and informal objections and against even decisions of the elected councillors. SPEAKERS AND SPEECHES
Chaired by the Secretary of the Moore Street Preservation Trust, Mícheál Mac Donncha (Sinn Féin Councillor), the crowd listened to a range of speakers: dramatist and campaigner for decades Frank Allen, 1916 relatives Brendan Mulvihill and Donna Cooney (latter a long-time campaigner and also Green Party Councillor), Diarmuid Breatnach for the Save Moore Street From Demolition campaign group (with a campaign stall every Saturday), Carolyn Alright (fourth-generation street trader), Stephen Troy (2nd generation local butcher) and Aengus Ó Snodaigh (Sinn Féin TD [member of the Irish Parliament]).

Each speech was different but of course sharing such themes as the struggle for Irish independence, historical memory and conservation but also closely linked to issues very much of the day: lack of justice in economic and social policy, lack of democracy in decision-making, reference to the housing crisis, property speculators, vulture funds, the banks ….. A number also made reference to the recent deaths of two homeless people in the vicinity.

There were some additional points made, for example Frank Allen called on people to tell the Fianna Fáil party they’d never get a vote in Dublin again if they didn’t act to save the area from demolition; Donna Cooney pointed out that demolition of buildings had a much worse effect on the environment than restoration; Diarmuid Breatnach stated that the area was of international historical importance and merited world heritage status; Stephen Troy spoke about the disaster for small businesses next to a 15-year building site; Caroline Alright pleaded for the future of the street to be taken out of the hands of the developers and Ó Snodaigh expected a more supportive attitude from the next Government (widely predicted to be a coalition with Sinn Féin as the larger partner).

Live music for the event was provided by Pat Waters, performing his own compositions, including a song about the O’Rahilly who was fatally wounded in 1916 in Moore Street leading a charge against a British Army barricade; also two musicians from the Cobblestone Pub, including the son of the owner, Tom Mulligan who performed Pete St. John’s Dublin in the Rare Aul’ Times.

There was speculation in some quarters as to why the rally had been called at such short notice; with prominent members of the Moore Street Preservation Trust absent1 and having an incorrect Irish name of the street2 on the event poster and promotional merchandise did seem to indicate a rushed event.
For some too, the Trust is being increasingly seen as closely linked to Sinn Féin, which for some is a positive factor but for others is not. The closeness has been evident on a number of occasions: a SF public meeting some years ago at which Jim Connolly Heron, prominent member of the Trust was the only speaker representing campaigners and more recently the promotion of the Trust’s Alternative Moore Street plan by SF, including the party President, Mary Lou Mac Donald, speaking at its launch a few months ago. At the rally on Saturday, the speaker for the Save Moore Street From Demolition campaign group made a point of saying that their group is independent of any political party.

However, the Bill to make the area a cultural quarter, currently proceeding with glacial slowness through the Dáil (Irish Parliament) is sponsored by a Sinn Féin TD, Aengus Ó Snodaigh, who spoke at the rally. Others counter by pointing out that Darragh O’Brien, a Minister of a party now in Government, Fianna Fáil, had sponsored a very similar bill back in 2015; however, with that party now the leading member of the current coalition Government, their leaders have welcomed the speculator’s plan for Moore Street.

GOVERNMENT
The Government department most concerned with the Moore Street issues is the Department of Heritage, part of the Department of Housing, Local Government and Heritage3. When Heather Humphries was the Minister responsible for Heritage she championed the bid of property speculator Joe O’Reilly to get control of Nos. 24-25 (owned by DCC) at the end of the central Moore Street terrace in exchange for the four buildings the State had declared a National Monument (Nos.14-17).
When Dublin City councillors voted not to allow that “land-swap”, against the recommendation of the City Managers, she castigated them publicly. She also instructed her legal team to appeal the High Court Judgement of March 2016 that the whole area is a National Historical Monument and in February was successful in having the judgement set aside.4 When Humphries attended Moore Street during the Easter 2016 events she was picketed and booed when she spoke. However, the current Minister for Housing, Local Government and Heritage Darragh O’Brien actually put in a submission against the proposed demolition of a building at the south end of Moore Street; however the Planning Department of Dublin City Council approved it.

As Minister 1n 2016, Humphries set up a Consultative Group on Moore Street on which all the Dáil political parties had a seat, along with a couple of councillors. From the campaigners, only the Jim Connolly Heron group had representation on it. The Minister’s group (latterly “Advisory”) has been in operation from 2016 until late last year but seems to have achieved nothing. The Hammerson Plan was welcomed by its Chairperson and by some of its members, including Brian O’Neill, Chairperson of the 1916 Relatives Association which seems a volte-face of that organisation, which had the conservation of the Moore Street battlefield as a central point of the Association’s constitution. However, the Hammerson plan was strongly opposed by others in the Minister’s Group, including Jim Connolly Heron. Outside the Minister’s Group, the opposition is even more widescale.

THE FUTURE
The planning permission given to Hammerson will be appealed to An Bord Pleanála but the Bord has a bad reputation with conservation campaigners, who see it as generally favouring the property developers5. Scheduling the appeal would take at least two months and possibly much longer. Should the campaigners not succeed at that stage, a legal challenge is also a possibility. Alongside the exploring of these options, street activities such as the rally on Saturday are likely. In 2016 conservation campaigners occupied the buildings for six days, blockaded them for six weeks, organised marches, rallies, pickets, re-enactments, concerts, history tours and public meetings.
Moore Street might be in for a hot summer. Or, given how long some processes have taken to date, even a hot Autumn.

However, it has been widely accepted in recent years that the correct name in Irish is Sráid an Mhúraigh, which is the one recorded in the State’s database for place-names, logainm.ie and furthermore is the version used in Sinn Féin’s own Bill currently proceeding through the Dáil.

On Saturday 22nd January 2022 an event was held to commemorate the centenary year of the occupation of the Rotunda building in Dublin by 150 unemployed workers led by Liam Ó Flaithearta, a Republican and Communist and writer from Inis Mór (off the Galway Coast). The occupation took place two days after the formation of the Free State and was attacked by an anti-communist crowd while after a number of days the occupiers were forced out by the police force of the new state of the dismembered nation1. The event last week was organised by the Liam and Tom O’Flaherty Society.
The event began with a gathering at 1.30pm in North Great George’s Street, where the Manifesto had been printed in 1922.2 People then proceeded to the nearby Rotunda, site of the occupation in 1922.3

Seosamh Ó Cuaig from Cill Chiaráin, Carna, Conamara, opened the proceedings as Chairperson, ag cur fáilte roimh dhaoine i nGaeilge agus i mBéarla, briefly introducing the historical occasion and recounting how some companies, including Boland’s, had supplied bread, sugar and tea to the occupiers, before he introduced published historian and blogger Donal Fallon.
Fallon not only recounted the events of that occupation 100 years ago but also placed it in context of a number of other factors: the unemployment then in the State (30,000 in Dublin) and to follow through into the 1930s, the upsurge in workers’ occupations and local soviets, the reactionary nature of the government of the new state and of the hierarchy of the Catholic Church at the time, which was very supportive of the new regime and extremely hostile to any kind of socialism, along with the cultivation of a reactionary social and political attitude among sections of the population.

Fallon also commented on the censorship and otherwise neglect of Liam Ó Flaithearta as an accomplished modern Irish writer and hoped for his writing to become more popularised now.

Alan O’Brien, Dublin poet and dramatist, was welcomed on to the stage to read the Manifesto which had been issued at the time, copies of which were available at a nearby stall. One of the aspects of that document was a call for Dublin City Council to set up public works to provide paid employment for those out of work in exchange for services to the community.
Diarmuid Breatnach, singer and blogger was invited to the stage to sing “The Red Flag” because it had been sung there during the occupation. No doubt those in the Government, Church hierarchy and generally among reactionary people at that time would have been horrified by the lyrics and would have asserted that they were foreign to Irish culture and thinking. However, as Breatnach explained, the lyrics had been composed by an Irishman (see Appendix 1), Jim Connell from Meath. Connell wrote the lyrics to the air of The White Cockade and was appalled to hear it sung to the air of Oh Tannebaum, a Christmas carol. Breatnach had never heard it sung to the White Cockade air but had been practicing it for days and hoped he would be faithful to the original air.

Called by the Chairperson to sing a follow-up song, Breatnach sang most of the verses of “Be Moderate”, satirical lyrics published by James Connolly in 1907 in New York. There had been no air published for the song and it has been sung to a number of airs but he would sing it to the air of A Nation Once Again, which provides a chorus:
We only want the Earth, we only want the Earth, And our demands most moderate are – We only want the Earth!
The event was later reported by RTÉ briefly in English on the Six O’Clock News and also by video on TG4’s Nuacht in Irish including interviews with Fallon an a number of participants.

APPENDIX 1:
THE RED FLAG: AUTHOR, LYRICS AND AIR
After the Rotunda occupation was terminated, Liam Ó Flaithearta emigrated to London, which is where the Red Flag lyrics had been composed twenty-three years earlier. The lyrics were composed by Meath man Jim Connell in London in 1889 to the air of the Scottish Jacobite march TheWhite Cockade — he was reported livid when he learned that it was being sung to the air of Oh Tannebaum, protesting: “Ye ruined me poem!”
Jim Connell was a Socialist Republican (he had taken the Fenian oath), activist and journalist who emigrated to England in 1875 after being blacklisted in Dublin for his efforts in unionising the docks in which he worked. Apparently he began to write the song lyrics on his way home from a demonstration in London city centre, on the train from Charing Cross to Honor Oak in SE London, where he lived and completed it in the house of a fellow Irishman and neighbour, Nicholas Donovan.

The lyrics have been sung by revolutionary and social-democratic (the latter less so now) activists all over the English-speaking world but also in some other languages in the years since.
Not mentioned in the Wikipedia entry on Jim Connell is the fact that he also wrote a book, apparently a best-seller in his time, called something like “The Poacher’s Handbook“. I’ve been looking for that book for years without success (DCC Library could find no reference to it).
UNVEILING PLAQUE ON JIM CONNELL’S HOME
Today there is a plaque on the two-storey house where Connell lived until his death in 1929, having been awarded the Red Star Medal by Lenin in 1922.

In the late 1980s a history archivist with the London Borough of Lewisham contacted the Lewisham branch of the Irish in Britain Representation Group, of which I was Secretary, to consult us about the erection of a history plaque on the house and the wording to use4. We attempted to have the words “Irish Republican” added to “Socialist” after his name on the plaque and were successful with “Irish” but not with “Republican”.
There was a handful at the unveiling at midday on a weekday, including a representative of the local Council, a couple from the Greater London Council including its Irish section, a trumpeter (who played the Oh Tannebaum air) and Gordon Brown (then just an MP). I believe this was 1989, the centenary of the song being written.
Brown’s speech did not mention Ireland once but as he finished, I jumped up on a nearby garden wall and while thanking those in attendance said that it was sad to see the country of Jim Connell’s birth omitted along with his views on Irish independence, particularly at a time when British troops were fighting to suppress a struggle for that independence.
This was during the age before mobile phones and I have no photos, sadly. So no big deal but the next edition of the Irish Post, a weekly paper for the Irish community in Britain, carried a report on the ceremony and my intervention. It was written by the columnist Dolan, who was the alter ego of the Editor, Brendan Mac Alua (long dead now) and a supporter of much of the IBRG’s activities.
I lived in Catford then, five minutes by bicycle from the site of the house and have photographed the plaque.
FENIAN CONNECTION BETWEEN LYRICS ACROSS TWO DECADES
The words and sentiment “Let cowards flinch or traitors sneer” in the Red Flag mirror some in a song celebrating Irish political prisoners, The Felons of Our Land: “While traitors shame and foes defame” and “Let cowards mock and tyrants frown”. Arthur Forrester wrote that song 20 years before Connell’s and it would be surprising indeed had Connell not consciously or unconsciously borrowed the construction and sentiment.
Arthur Forrester was himself of great interest as were his poet sisters, both raised by their Irish nationalist mother, also very interesting person and poet in her own right, in Manchester, known to Michael Davitt. Arthur was a Fenian and did time in prison for it5. He was also for a period proof-reader for the Irish Times! Frank McNally wrote an article about the song but I don’t have access to anything except the first few lines.

1Not long afterwards, the new Free State’s National Army, under the orders of Michael Collins, attacked a protest occupation by Irish Republicans of the Four Courts which began the Civil War of the State against the IRA, lasting until 1923 with over 80 executions of Republicans by the State along with many kidnappings and assassinations (such as Harry Boland’s and of course others killed in battle (excluding the shooting of surrendered prisoners, which the National Army also did on occasion). Some were even murdered AFTER the war had ended, for example Noel Lemass, his body left in the Dublin mountains.
2Possibly this was the same location which had housed the James Connolly College (raided by the Auxiliaries in 1921).
3Also the location of the first public meeting to launch the Irish Volunteers in 1913 and where much of the GPO garrison and others were briefly kept prisoner after the surrender in nearby Moore Street in 1916. 4The Lewisham branch of the IBRG had been founded in 1986 and founded the Lewisham Irish Centre in 1992, I think. The IBRG itself was founded in 1981 and was active on many issues, including anti-Irish racism, representation for the diaspora, release of the framed Irish prisoners, British withdrawal from Ireland, against anti-Traveller racism, plastic bullets and strip-searches. It was also for equality in general, being against all racism, gender discrimination and homophobia and one year shared a march with the Broadwater Farm campaign.
5 Despite the Irish diaspora having given the working class in Britain its anthem (The Red Flag), its classic novel (TheRagged-Trousered Philanthropists) and, among many social and trade union activists and leaders, two leaders of the first genuine mass workers’ movement in Britain (the Chartists — O’Brien and O’Connor), and having fought against the Blackshirts at the Battle of Cable Street, there is no BA in Irish Studies alone available in British Universities. It would seem that the British ruling class does not want its population to know in any depth about the Irish.
Last Saturday in the Teachers’ Club in Dublin (26/11/21), the revolutionary music Grup Yorum from Turkey, with some Irish musician input, played to an audience of up to two hundred. In between performing different numbers from their repertoire, band members spoke to the audience of the history of the struggles of their people and of the band.
The Irish tour of the band was organised by the Anti-Imperialist Action Ireland organisation; earlier that week Yorum played in a small music venue in Belfast to around 40 people. The attendance in Dublin was so large that the location had to be changed from a large room on the first floor to the much larger hall down below.

BELFAST
In Belfast in the Sunflower Lounge, Bobby Fields from Armagh and Séan Óg from Dublin entertained those in attendance with songs of Irish resistance followed by Grup Yorum coming on afterwards. The Grup’s performance was enthusiastically received and was followed by a questions-and-answers session to learn more about the situation in Turkey.
The Grup members toured some of the area and visited the famous international solidarity wall along with the grave of Bobby Sands, where paying their respects included singing a song at the graveside.
DUBLIN
In the large hall in the Teachers’ Club, Dublin, Séan Óg took to the stage first, playing guitar to accompany himself on guitar to sing The Killmichael Ambush, Viva la Quinze Brigada, Back Home in Derry1 and The Internationale. Veteran activist and traditional singer Diarmuid Breatnach followed, singing unaccompanied the Anne Devlin Ballad, I’ll Wear No Convict’s Uniform2and James Connolly’s satirical song Be Moderate3. Some of the audience sang along with some of the lyrics sung by each singer.

The four members of Grup Yorum present then took to the stage to huge applause and addressed the audience in Turkish, their words being translated into English by a member of their entourage. In the performance that followed, two guitars, flute and cajón were the instruments with a male and female leading voices. Each song was preceded by an explanation placing the piece in historical and political context.
Some of the songs in particular were clearly known to Turkish and Kurdish people in the audience and at some points they sang along, often waving an arm in the air. Towards the end of their performance the crowd got more and more excited and then Seán Óg joined them for a couple of numbers.

The Grup’s interpreter made a special appeal for help from those in attendance to pressurise the Turkish authorities to release political prisoner Ali Osman Köse who has been in solitary confinement for 20 years and has multiple health issues. There are fears for the man’s life as he has had a cancerous kidney removed in May of this year without any follow-up treatment and despite everything has been pronounced “fit” to continue in jail.
This was followed by members of the Resistance Choir taking to the stage to join Grup Yorum in a rendition of the Italian antifascist Bella Ciao! Song before Diarmuid Breatnach returned to the stage to bring the evening to a close with the first verse and chorus of Amhrán na bhFiann4 with members of the audience joining in (including some from Anatolia)

THE GRUP YORUM BAND
A revolutionary music band from Turkey, Grup Yorum members compose their own material and the band has has released twenty-three albums and one film since 1985. The band has suffered repression with some concerts and albums banned and members have been arrested, jailed and tortured, two members also dying on hunger strike. The band is popular in Turkey and as well as their albums selling well in Turkey and internationally, it has also given concerts in Germany, Austria, Australia, France, Italy, the Netherlands, Belgium, Denmark, United Kingdom, Greece and Syria.
Grup Yorum publishes an art, culture, literature, and music magazine entitled Tavir, and several group members manage a cultural centre called İdil Kültür Merkez in the Okmeydani neighbourhood of Istanbul.

Queen’s University Belfast appointed Hillary Clinton as the institution’s Chancellor1. On 24th September 2021 the University authorities organised an event to mark her formal inauguration; however a large and voluble crowd gathered to protest the inauguration and the authorities’ choosing her as Chancellor of the University. Among the shouts of protesters were “War criminal!” and “Hillary, Hillary, Hillary – Out, out, out!” (This story is now “old”, apologies but nevertheless worth posting for those who might not be aware of it as media coverage was muted)
Although the Belfast Telegraph’s coverage of the event made no mention whatsoever of protests, they were reported in a number of other media. The protest saw Irish Republican and Left socialist groups come together to carry out the protest, with a number of them taking turns to speak.
The speakers at the protest included Pól Torbóid of Lasair Dhearg; Aidan Moran, a former ISM activist in Occupied Palestine, on behalf of Cairde Palestine; Conal MacMathúna on behalf of the Connolly Youth Movement; Local Councillor Michael Collins from People Before Profit; and Dr. Azadeh Sobout, Scholar of Transitional Justice and Peace building and Member of Academics for Palestine.
In addition to Irish organisations’ banners and flags, the national flags of Palestine and Cuba were also in evidence.
Hillary Clinton has been a member of the USA Congress from 2001 to 2009, followed by Secretary of State from 2009 to 2013, having also held the ceremonial position of First Lady during her husband Bill Clinton’s tenure as President of the USA 1993-2001. The Secretary of State of the USA, appointed by the President with the advice and consent of the Senate, is the President’s chief foreign affairs adviser. The Secretary carries out the President’s foreign policies through the State Department and the Foreign Service of the United States.
Lasair Dhearg’s Pól Torbóid, who helped organise and also spoke at the event, said, “Queen’s University’s complicity in the whitewashing of Hillary Clinton and her war crimes further epitomises the university’s role in an international framework of imperialism that sees it not only glorify warmongers like Clinton, but have immense financial investment in military contracts and companies guilty of immense environmental destruction.”
“Queen’s has facilitated the visitation of many war criminals and parasites over the years, but arguably none as big as the visit of Hillary Clinton as its chancellor. A proud Zionist and imperialist; with a war record as long as your arm, Clinton has helped oversee US bombing campaigns in over 9 countries.”
“As US secretary for war, she authorised over 400 drone strikes across multiple nations, which overwhelmingly killed civilians and even children at a proportion of almost 90%.”
“She labelled black men ‘super-predators’ when she helped lobby for the 1994 US Clinton Crime Bill, which was immensely important in creating the mass incarceration levels that exists today in the US to benefit the prison-industrial complex – which is a system of slavery by new means.”

In the UK university system, the office of Chancellor is held by a distinguished individual, from academia or public life, who is not usually resident and does not hold any other University office.
On Friday morning passing pedestrians, public and private transport drivers and passengers on Dublin’s Finglas Road witnessed a funeral cortege in which trade union banners and flags were carried by some of the mourners. The hearse leading the procession, followed by a lone piper did not bear the Starry Plough-draped coffin which instead was carried on the shoulders of a rota of family, comrades and friends on the approximately one-kilometre walk from the home of Manus O’Riordan to service at the famous Glasnevin Cemetery.
A large crowd participated in the funeral procession composed of a wide cross-section of the Irish Left, from revolutionaries to radical reformers to sedate social democrats. Manus was well known in Irish left-wing circles for a number of reasons. At various times he had been an active socialist, a member of the very small but influential and very controversial B&ICO, a senior official in the major trade union SIPTU and an active senior member of the Friends of the International Brigades Ireland. This last owed much to the fact that Manus’ father had fought in Spain and the veneration in the Irish Left and much of the Irish Republican movement for the Irish volunteers who fought to defend the Spanish Republic against the fascist-military uprising led by General Franco and aided by Nazi German and Fascist Italy. Mick O’Riordan survived the Spanish Antifascist War and was General Secretary of the Communist Party of Ireland and the last time some of the mourners had walked this route was in the elder O’Riordan’s funeral in 2006.

The trade union banners marked Manus’ trade union work while another signalled his support for the Cuban Republic against the blockade imposed upon it by the USA. Two large flags in the red, gold and purple of the Spanish Republic of 1936-1939 were carried too, bearing the legend “Connolly Column” (in Irish and in English) to represent the Irish volunteers who fought against the military-fascist coup. Along the route, copies of a combined Spanish Republic and Starry Plough, attached high upon lampposts, fluttered or strained outwards in the breeze. Among the procession a number of Starry Plough flags flew also, the green and gold version of the Irish Citizen Army, along with a Basque and a Palestinian flag, the latter recalling the stand of the Basque country against Franco and the former, Manus’ solidarity with the struggle of the Palestinian people. At one point, the Catalan Senyera (flag) was also displayed, recalling that in the Ebro Offensive, Michael O’Riordan had been chosen to carry the Catalan flag across the Ebro river. A number of people also wore scarves of the Bohemian Football Club, with supporters among Manus’ family and friends.

Though cold, the day remained sunny and most thankfully of all, rain-free. Upon reaching the cemetery, the coffin was taken into the chapel near the entrance at which non-religious or religious services may be chosen. Due to Covid19 restrictions, the service was reserved for family and close relatives only.
The rest of the crowd gathered outside and perhaps before 11 am a burst of applause heralded the approach of the President of the Irish State, Michael D. Higgins, accompanied by a senior member of the Irish armed forces in ceremonial uniform. The applause was no doubt in appreciation for Higgins’ appearance and due to his office but also certainly in approval of his decision not to attend a forthcoming British colonial state function to celebrate the centenary of the partition of Ireland in 1921. And also no doubt in sympathy to the controversy regarding his decision whipped up by sections of the British and Irish media and a handful of politicians, not only British and Unionist.

There was an ex-president of a different kind present too, Jack O’Connor, who was elected General President of the SIPTU (trade union) in 2003 for three terms and in 2009, President of the Irish Congress of Trade Unions. O’Connor took a stint sharing the weight of the coffin and though no doubt he had his supporters in the crowd he had a substantial number of enemies in the trade union movement too, though this is not the place to speak of the reasons.
Among others who attended to pay their sympathies to the O’Riordan family and Manus’ partner Nancy Wallach were Minister for Finance Paschal Donohoe, Sinn Féin president Mary Lou McDonald and Sinn Féin TDs Louise O’Reilly and Sean Crowe.
Former Labour Party leader Ruairí Quinn, former Press Ombudsman and Labour TD John Horgan, Communist Party of Ireland Gen. Sec. Eugene McCartan and retired trade union leader Mick O’Reilly of Unite were also there.

After the service, some of the attendance repaired to the not very distant Maples Hotel in Iona Road, where food had been prepared and refreshments could be purchased. Even with the crowd by then much diminished, they were spread over two reception rooms and had to be fed in shifts.
Manus’ sister Brenda playing a piece on the harp by medieval Irish musician Turlough O’Carolan while his daughter, Jess read a poem by Charlie Donnelly, who died fighting fascism in Spain, “The Tolerance of Crows” and his son, Luke sang the “Roll Away The Stone” song celebrating workers’ leader Jim Larkin (a song often sung by Manus himself in the past.
Manus was a regular participant in the singing session of the Góilín where he sang songs, in some of which the lyrics were his translations into Spanish, Irish or English and some were of his own composition. He composed poetry too. Accordingly, a significant section of the attendance at his funeral was composed of singers and participants of the Góilín and it was strange to hear no song sung during the procession or among the crowd outside; however folk singer Radie Peat of Lankum sang Liam Weldon’s song Via Extasia and Gerry O’Reilly sang The Parting Glass before Francis Devin sang the socialist anthem The Internationale before Manus O’Riordan’s coffin draped in The Starry Plough was removed for cremation.. At least one occasion to pay respect to Manus’ memory is promised in the future and no doubt song will play an important part of the proceeding then.
Manus O’Riordan wrote and lectured copiously over the years on a number of topics and over time revised some of his opinions, never shrinking from doing so publicly and renouncing a previous position strongly held. All his assertions were backed by arguments in favour and never merely by assertion.

Despite the numerous verbal battles in which Manus took part in speech and print, a number of them quite heated, he managed to remain on speaking terms with most people including his political enemies and had a wide range of friends and of people with whom he was on good terms. He lived an active and useful life but one cut short too soon at the age of 72.
There will be a number of groups and occasions where his absence will be keenly felt and of course by his family and his partner Nancy Wallach.
The Dublin police played a fundamental role in the creation of the first workers’ army in the world, the Irish Citizen Army.
The Dublin employer syndicate’s offensive against the working-class “syndicalism” of the Irish Transport & General Worker’s Union1 began with the 1913 Lockout, in turn triggering strikes on August 26th, when workers were presented with a document they were to sign declaring that they would leave the ITG&WU or, if not a member, would refuse to support it in any action2. Most workers of any union and none refused to sign and 20,000 workers were confronted by 400 employers.
However, the employers’ numbers were added to by the Dublin Metropolitan Police and the Royal Irish Constabulary, backed up by the judiciary. Morally and ideologically the Irish Times and Irish Independent (the latter owned by W.M. Murphy, leader of the employers) backed the employers as, to a large extent, did the Irish Catholic Church hierarchy3.

The national (non-workers’) movement was divided in its opinion: many of Redmond’s Irish Parliamentary Party representatives were employers or landlords and their sympathies were naturally not with the workers. But for example Seán Mac Diarmada, a republican and national revolutionary, organiser for the secret Irish Republican Brotherhood4, opposed the strike on the basis that foreign business interests would profit by the paralysing of Irish business concerns5. On the other hand, Mac Diarmada’s mentor and head of the IRB in Ireland, Tom Clarke, was sympathetic to the strikers.
POLICE RIOTS
Unlike the gendarmerie6 British police force throughout Ireland of the Royal Irish Constabulary, at this time the constables of the DMP were unarmed except with truncheons but even with those they managed to kill people. On 30th August 1913 the DMP baton-charged a crowd in a street meeting on Eden Quay, outside Liberty Hall, HQ of the union7. Among the many injured were James Nolan and John Byrne who died 31st August and 4th September respectively, both in Jervis St. Hospital. (see also other riots and police attacks in Sources & Further Reading below).
On the 31st Jim Larkin went in disguise to address an advertised public meeting, banned by a magistrate, in Sackville (now O’Connell) St., Dublin. In view of the behaviour of the police, most of the IT&GWU activists went instead to their rented facilities at Fairview but a large enough crowd of the committed and the curious were assembled in O’Connell Street, along with large force of the DMP. Larkin, disguised as an elderly Protestant minister arrived by horse-drawn carriage and, as befitted a man made infirm by age, was assisted by Nellie Gifford8 into the Clery’s building which housed the Imperial Hotel restaurant, which belonged to W.M. Murphy (as did the Dublin Tram Co.). In order that Larkin’s strong Liverpool accent should not give him away, Nellie Gifford did all the talking to the staff inside. Shortly afterwards Larkin appeared at a restaurant window on the first floor and, top hat removed, spoke briefly to the crowd below but, as DMP rushed into the building, tried to make his getaway.

The DMP arrested Larkin and when the crowd cheered him (led by Constance Markievicz), the DMP baton-charged the crowd, striking out indiscriminately, including knocking unconscious a Fianna (Republican youth organisation) boy Patsy O’Connor who was giving First Aid to a man the police had already knocked to the ground. Between 400 and 600 were injured and Patsy suffered from headaches thereafter; though active in the Republican movement (he was prominent in the 1914 Howth guns collection9) he died in 1915, the year before the Rising. Among those beaten were journalists and casual passers-by. Those caught in Princes Street10 between DMP already in that street and the police charging across the main street were beaten particularly savagely.
The police attack became known as “Bloody Sunday 1913” (though two workers had been fatally injured on Eden Quay the day before and are often wrongly listed as having been killed on that day).

Also on that day the DMP attacked the poor working-class dwellings of Corporation Buildings (in “the Monto”, off Talbot St11), beat the residents and smashed their paltry furniture. The raid was a revenge attack for the reception of bottles and stones they had received on the 30th, when they were chasing fleeing workers from Liberty Hall (others crossed Butt Bridge to the south side and a running battle took place along Townsend Street and almost to Ringsend.

THE IRISH CITIZEN ARMY 1913 AND 1916
Very soon after those attacks, Larkin and Connolly each called publicly for the formation of a workers’ defence force, which became the Irish Citizen Army. Around 120 ICA, including female members fought with distinction in the 1916 Rising and raised their flag, the Starry Plough on the roof of WM Murphy’s Imperial Hotel on the upper floors of Clery’s building, opposite the GPO13. A number of its Volunteers were killed or wounded in action and two of the ICA’s leaders, Connolly and Mallin, were executed afterwards; another, Constance Markievicz, had her sentence of death commuted.

The end of August 1913 on Eden Quay and in O’Connell Street may be seen as the period and birthplaces of the ICA, the “first workers’ army in the world” and the first also to recruit women, some of whom were officers.

1The ITGWU was formed in 1909 by James Larkin, former organiser for the National Union of Dock Labourers after his bitter departure from that union. Most of the members Larkin had recruited for the NUDL, with the exception of the Belfast Protestant membership, left the NUDL and joined the IT&GWU.
2The provision in the declaration for members of unions other than the iT&GWU was necessary for the employers because of the general credo in Irish trade unionism that one did not cross a picket line, whether of one’s own union or of another, a credo that persisted in Ireland until the 1980s when the Irish Trade Union Council joined the “Social Partnership” of the State and the employers’ Federation. In addition, Larkin had added the principle that goods from a workplace on strike, even if strike-breakers could be got to bring them out, were “tainted goods” and would not be handled by members of the IT&GWU, nor should they be by any other union either.

In 1843 the lyrics of In Memory of the Dead were published anonymously in The Nation but it seems to have been an open secret in Dublin political circles that the author was John Kells Ingram. As often happens, the song became known by its opening line “Who Fears to Speak of ‘98” and years later Ingram admitted having written the lyrics. Though it never once mentions Daniel O’Connell, taken in context of its subject, time and where it was published, the song was a blistering attack on the politician and his Repeal of the Union organisation. Yet while Kells Ingram was many things, he was no revolutionary — unlike the editors of the Nation and many of its readers.

John Kells Ingram was a mildly nationalist mathematician, economist, philosopher and poet who was selected to write expert entries for the Encyclopedia Britannica. But although he was no revolutionary it is clear that he felt a distaste for O’Connell’s distancing himself from the memory of those who had risen in rebellion four decades earlier.

Supporting O’Connell initially, The Nation sought to create a patriotic and indeed revolutionary culture through its pages. One of The Nation’s founders and editors, Thomas Davis was perforce also one of the periodical’s contributors and his compositions The West’s Awake and A Nation Once Again are still sung today, the latter very nearly becoming Ireland’s national anthem. The lyrics of Who Fears to Speak celebrated historical memory of resistance and lamented death and exile, the latter to the USA, where many of the surviving United Irish had gone (“across the Atlantic foam“). Davis’ In Bodenstown’s Churchyard, commemorated and celebrated Theobald Wolfe Tone, remembered as the father of Irish Republicanism and martyr.

Three years after co-founding The Nation, Thomas Davis died of scarlet fever in 1845, a few months short of his 31st birthday. Two years later, in “Black ‘47”, the worst year of the Great Hunger, the Young Irelanders finally and formally split from O’Connell’s Repeal Movement and in 1848 had their ill-fated and short uprising – again jail and exile for the leaders followed. Just under a score of years later, 1867 saw the tardy and unsuccessful rising of the Fenians with again, resultant jail sentences and exile (in addition to the executions of the Manchester Martyrs).
Two years following the rising of the Young Irelanders, in 1850 Arthur M. Forrester was born near Manchester in Salford, England (the “Dirty Old Town” of Ewan McColl) and in 1869 his stirring words of The Felons of Our Land appeared in Songs of a Rising Nation and other poetry (Felons reprinted by Kearney Brothers in a 1922 collection including songs by Thomas Davis). Songs of a Rising Nation was a collection published by the militant and resourceful Ellen Forrester from Clones, Co. Monaghan, who struggled to raise her children after the early death of her husband and included poems by her son Arthur and daughter Cathy.
Felons of Our Land indeed contains some of the themes of Who Fears to Speak (of which Arthur was doubtless aware) but in addition those of jail and death on the scaffold. By that time, the Young Irelanders had been added to the imprisoned and exiled, some in escape to the USA but others to penal colony in the Australias. And Forester added the theme of pride in our political prisoners:
A felon’s cap’s the noblest crown
an Irish head can wear.
and
We love them yet, we can’t forget
the felons of our land.
Twenty years after the publication of The Felons of Our Land, in 1889, another Irishman, Jim Connell, writing in SE London, would contribute the lyrics of the anthem of the working class in Britain, The Red Flag. Although commonly sung to the air of a German Christmas carol, Connell himself put it to the the traditional Jacobite air of The White Cockade. Connell, from Crossakiel in Co. Meath, also invoked historical memory and included the theme of martyrdom in explanation of the flag’s colour:
The workers’ flag is deepest red —
it shrouded oft’ our martyrs dead,
And ‘ere their limbs grew stiff and cold
their life’s blood dyed its every fold.

The traditions and themes of resistance and struggle are handed from generation to generation and song is one of the vehicles of that transmission. But songwriters borrow themes not just from history but from the very songs of the singers and songwriters before them. In 1869 Arthur M. Forrester wrote in Who Fears to Speak of ‘98:
Let cowards mock and tyrants frown
ah, little do we care ….
Jim Connell, three decades later, took up not only the themes but also that line:
Let cowards mock and traitors sneer,
we’ll keep the red flag flying here.

The undemocratic non-jury Special Criminal Court was renewed for another year in the Dáil yesterday evening with the lowest abstentions or vote against it ever. All Sinn Féin’s TDs (members of the Irish parliament) absented themselves and FG, FF, Greens and Labour all voted for another year’s renewal, with the Social Democrats abstaining. Seven votes were cast against it, the lowest ever since it was brought in as part of the Offences Against the State Act in 1972.
Voting against renewal were the five PBP/Solidarity TDs (Bríd Smith, Richard Boyd Barrett, Gino Kenny, Mick Barry, Paul Murphy) and the two left-wing Independent TDs: Joan Collins and Thomas Pringle. Sinn Féin, who abstained in 1920 for the first time after decades of opposition, just didn’t attend at all this time. In 1920 they said that they were awaiting a review of the Act promised by the Justice Minister – but without any explanation of what in the review could possibly convince them to keep the Act in place. The Social Democrats, whose amendment to bring the Special Court to an end by a deadline of June 29th next year was rejected, abstained in the vote.

SINNFÉIN ABANDONS DECADES OF OPPOSITION TO THE SPECIAL CRIMINALCOURT
Since the Acts’ inception, Sinn Féin has voted against the annual renewal – until last year, when they abstained and this year, absented themselves from the Dáil before the vote. For some years now, the party has been reshaping itself to take part in a coalition government with one of the government parties. Supporters of the party who believe this a necessary disguise to enter the corridors of power and that the party will then return to its Republican past will find that for whatever principle the party gives up voluntarily, a further one will be extracted by pressure. Those who crawl into government will never be able to stand up in it later.
James Geoghegan, FG’s candidate for the forthcoming by-election in Dublin Bay East, taking a swipe at SF’s candidate Lynn Boylan, said “When it comes before both the Dáil and Seanad, what will Sinn Féin and Senator Lynn Boylan do? Will they abstain yet again, which undermines the laws in place to keep our citizens and democratic institutions safe?
“If Senator Boylan wishes to be a senior legislator and member of Dáil Eireann, she must show her support for the institutions of the State and do all in her power to protect the public from criminality and the threat of terrorism.”
Note that Geoghegan has no difficulty in equating support for “democratic institutions” with supporting their very negation, such as jury-less trials.

Sinn Féin party leaders may think that in not opposing the SCC’s renewal, they are abandoning only some Republican principles, as Republicans have been the main victims of the Special Criminal Court to date but in fact they are also colluding in a major attack on civil and human rights, as pointed to by the opposition of civil and human rights organisations to the SCC.
OPPOSITION OUTSIDE THE DÁIL

Outside the Dáil, which has been held in the Convention Building on the Dublin quays since the Covid 19 measures, a protest picket took place before the vote. The demonstration was organised by the Abolish the Special Courts campaign and supported by a mixed attendance of Republicans, Socialists and Anarchists.
A number of passing motorists, particularly in company vans and lorries, blew their car horns in solidarity in passing, some also extending a clenched fist or “thumbs up” sign out of their window.
Left Independent TDs Thomas Pringle and Joan Collins joined the picketers for a while and Richard Boyd Barrett chatted with them in passing too; all three posed for a photo while holding a placard against the SCC before returning to the Dáil to speak and vote against the juryless court.

The Abolish the Special Courts campaign was launched in 2017 and a public meeting the campaign group organised in Dublin in 2018 heard about a number of then recent cases of unjust convictions in the non-jury courts. Since then the campaign group has organised protests against the SCC.

IRISH STATE TERRORIST LEGISLATION ASSISTED BY BRITISH TERRORISM
The Special Criminal Court, as stated earlier, is part of the Offences Against the State Act (OAS) 1939, which is sometimes described as the Irish State’s anti-terror legislation. However, the setting up of the Special Criminal Court and the infamous Amendment to the OAS which allows convictions of “membership of an illegal organisation” solely on the unsupported word of a Garda at superintendent rank or higher, was in fact passed on a wave of hysteria after a terrorist bombing in 1972 by British Intelligence terrorists.

On the evening of December 1st, 1972, a car bomb exploded near Liberty Hall in Dublin and although there were no fatalities in that explosion, many were injured. A second bomb a short time later at Sackville Place, off O’Connell Street, killed Mr George Bradshaw (29), a bus driver, and Mr Duffy (24), a bus conductor.
The indications had been that Fine Gael and Labour were both going to vote against the Fianna Fáil proposals but in the panic after the the explosions, which were blamed against all logic on the IRA, the opposition to the Acts collapsed and they passed.
THE PRETENCE OF “TEMPORARY PROVISIONS”
The Acts must be voted upon annually because, as with much emergency legislation across the world, the myth is propagated that the provisions are temporary; however these “temporary measures” have now been in place for 82 years! To give another example, the specifically anti-Irish emergency legislation introduced to Britain in 1974, the annually-renewable Prevention of Terrorism Act, was only abolished 15 years later to be replaced by the Prevention of Terrorism Act 1989 (again “Temporary Provisions”) which in turn was replaced by the Terrorism Act 2000.
The powers this Act provide the police have been controversial, leading to noted cases of alleged abuse, and to legal challenges in British and European courts. The stop-and-search powers under section 44 of the Act have been ruled illegal by the European Court of Human Rights.
That Act was strengthened by the Prevention of Terrorism Act 2005, which was then replaced by Section 1 of the Terrorism Prevention and Investigation Measures 2011. All repressive legislation in Britain has now ceased even the pretence of being temporary.
A similar trajectory has been followed by “emergency” legislation in the Six Counties statelet, from the very creation of the administration in 1921 (with the Emergency Powers Act of 1920), a new Act in 1926, amended in 1964 and replaced by the Civil Contingencies Act 2004, providing unlimited powers of harassment for the colonial police along with refusal of bail, undemocratic bail conditions and easy convictions for the non-jury Diplock Courts.

NON-JURY COURTS
Historically, on occasion juries have been misled and have also been complicit in unjust verdicts, convicting innocent people (there are infamous cases such as the Irish-related ones in Britain in the 1970s, the Birmingham Six, Guildford Four, Maguire Seven, Giuseppe Conlon and Judith Ward). But much less so than non-jury courts. The right to be tried by a jury empaneled by random selection is considered across the world a fundamental democratic right and, furthermore, is one that has been fought for across the centuries, first to win the actual right, then to apply it across classes and finally to apply it to women and ethnic minorities.
The Six County colony has the Diplock non-jury courts and the Irish State has the SCC, both emergency and undemocratic measures in two states that are supposed to be democracies. Both courts regularly remand accused in custody without bail or impose undemocratic restrictions on the few occasions when bail is granted, such as having to be indoors by a specific time daily, prohibition from attending political meetings, etc. At trial, the required burden of proof on the Prosecution is very light indeed, ensuring an unnaturally high rate of convictions.

The Irish Council of Civil Liberties, which was founded in 1976 by people concerned about the increase in repressive powers of the Irish State, has stated that the court “continues to represent the single biggest denial of fair trial rights in our legal system”. The SCC has also been condemned by Amnesty International and the Human Rights Commission of the United Nations.
Whereas apologists for these undemocratic and repressive measures argue that non-jury courts are necessary because jurors might be intimidated, they fail to produce evidence of this having happened. However, there is hard evidence of unjust convictions by the Special Criminal Court.
In 2017 Michael Connolly, who had already spent 14 months in prison had his SCC conviction for alleged membership of the IRA overturned and a retrial ordered, during which he was found “not guilty”. Assistant Commissioner of the Gardaí Michael O’Sullivan was judged to have been “careless” in producing a single piece of “evidence” twice as the basis of his belief of the man’s guilt, which made it appear that there were two pieces of evidence, which the SCC considered sufficient to convict.
In 1986 the Special Criminal Court found Osgur Breatnach, Brian McNally and Nicky Kelly guilty of robbing a mail train near Sallins, Co. Kildare. They were innocent but had “confessed” after beatings in Garda custody, which the Prosecution claimed they had inflicted upon themselves and which the SCC accepted despite vigorous denials and the fact that Breatnach had been in a cell on his own. The three were sentenced to between nine and 12 years but their convictions were later overturned and they were paid compensation by the State in acknowledgement of their innocence. “Whistleblower”, a multi-media work on the unjust convictions organised by musician Cormac Breatnach, a brother of one of the victims of the SCC, has won Irish and international awards –but the SCC continues in operation and to be supported by TDs year after year.
SHAME!
This year and last were the worst years in the existence of the undemocratic court, with lowest votes ever recorded against it. As the Abolish Special Courts campaign succinctly summarised the vote in the Dáil: “Shame on those who used to support the abolition of non-jury special courts who now vote in favour of it, abstain or don’t show up to vote at all.”
